This is the Layman’s Version of my general terms of service a for commissioned artwork.

  • Description: The product will be a digital file (e.g. PNG, JPEG, GIF)
  • Right of Refusal: I can turn down any request for any reason. I will draw explicit content only for other adults.
    • I follow United States laws; when you commission me, you agree to also follow those laws. If you fail to follow U. S. law or your own laws, I’m not responsible or liable.
  • Payment Method: I will only use COMMISS.IO to conduct transactions, unless we decide otherwise. You do not need an account on COMMISS.IO to use the site.
  • Contact Method: We will communicate using COMMISS.IO unless we decide otherwise. If you cannot reach me there or have other inquiries, use my contact page.
  • Cancellation & Reimbursement: I can cancel a commission at any time, and unless you are the cause of me cancelling it, you will be reimbursed.
    • Kill Fees: 
      • If you cancel your request before I have done anything, you will get a full refund.
      • If you cancel your request after I start working, you will be billed depending on the type of project and how much work I’ve already done, including research.
      • NOTE: Commissions done through COMMISS.IO‘s platform will adhere to the cancellation policy specified on COMMISS.IO for that piece
    • Down Payment Reimbursement:  If you don’t respond to me for two weeks or more or ignore me, I do not have to finish your commission and you will not be reimbursed for any down payment made.
  • Usage Rights: Rights refers to copyright: your right to copy. Any right not granted to you belongs to me, and you only gain rights once I get full payment.
    • For non-commercial artwork (e.g. personal use commission): You can use the work for personal reasons, such as posting it to your blog or social media accounts or having the work printed to be gifted or displayed in your home or office or other private, non-commercial location–that is, you may not mass-produce it for sale, have it printed in a magazine or newspaper, displayed in a gallery, etc. without contacting me to purchase those rights.
    • For commercial artwork: I will send you a contract for the specific project and we can negotiate. Any rights I don’t grant you default to me. You will have to pay me for using any rights not granted to you.
  • Attribution/Credit Line: Credit me. @ me in social media or state “by K. M. Claude” or “© [Year], K. M. Claude” on your site.
  • Alterations:  You cannot alter the work you receive.
  • Revisions: Unless we agree otherwise, I will send you sketches to approve. Any changes after this approval or completely changing your mind about what you want will cost extra.
  • Limitation of Liability: I am not liable for damages if the work is late.
  • Unauthorized Use: You will compensate me any expenses that may arise if the work is used in a way that breaks those rights above.
  • Ownership: I own the work and hold the rights (except the rights I granted you). I can use the work in my own portfolio(s).
